تتناول هذه المقالة العلمية “جريمة استمالة الأطفال عبر الانترنيت لأغراض جنسية” والتي تسمى بالإنجليزية Grooming، والمنصوص عليها في اتفاقية مجلس أوربا حول مكافحة الاستغلال الجنسي للأطفال. وتنطلق المقالة من المخاطر التي باتت تهدد الأطفال في الفضاء الرقمي، الذي بقدر ما يتيحه من فرص وإمكانيات للأطفال في مجال التواصل والتعارف والمعرفة، فإنه أصبح أيضا فضاء للمجرمين، الذين يتصيدون الأطفال من خلال إغوائهم واستمالتهم لأغراض جنسية عبر مختلف منصات التواصل الاجتماعي. وتعد جريمة الاستمالة من الجرائم الحديثة المرتبطة بتطور التكنولوجيا الرقمية، وسوف نوضح من خلال المقالة مفهوم هذه الجريمة، وطرق ارتكابها، وتفسيراتها حسب اتفاقية لانزروتي، ومدى ملائمة التشريع المغربي للتنصيص عليها والمعاقبة عليها.
This scholarly article addresses the crime of online child grooming for sexual purposes, commonly known in English as “Grooming,” as stipulated in the Council of Europe Convention on the Protection of Children against Sexual Exploitation and Sexual Abuse. The article proceeds from the inherent risks that now threaten children in the digital space. While this space offers numerous opportunities and possibilities for children in terms of communication, social interaction, and knowledge acquisition, it has also become a hunting ground for criminals who prey on and lure children for sexual purposes across various social media platforms. The crime of grooming is considered a modern offense intrinsically linked to the evolution of digital technology. Through this article, we will elucidate the concept of this crime, its methods of perpetration, its interpretations according to the Lanzarote Convention, and the extent to which Moroccan legislation is adequate in stipulating and penalizing it.
