الإطار القانوني والمؤسساتي للطاقات المتجددة في المغرب: التجليات والتحديات

ملخص:

يعد التشريع الطاقي الأساس الذي تقوم عليه أسواق الطاقة عموما، والمتجددة على الخصوص. وعلى الرغم من أهمية قوانين وسياسات الطاقة المتجددة، يبدو واقعيا أنها لا تزال متواضعة الانتشار في العديد من الدول، وأن تطبيق الحلول التي تقدمها المصادر المتجددة يظل مرهونا بالتشريعات والأطر المؤسساتية والسياسات التحفيزية وآليات التمويل والتنفيذ والمتابعة والتقييم التي تقرها الدولة للتوفيق بين أصحاب المصالح. ولئن ركز هذا العمل على القوانين والمؤسسات الفاعلة والمؤطرة لمجال الطاقات المتجددة، لفت الانتباه أيضا إلى أن التقنين والمأسسة لا يمكنهما لوحدهما إنجاح الاسترتيجية الطاقية؛ إذ توجد عوامل وتحديات عديدة تتدخل في العملية، منها، مثلا، العوامل البشرية ومدى توفر الكفاءات العلمية والتقنية القادرة على تنزيل وبلورة الاستراتيجية الطاقية  بالشكل المطلوب، وهنا نتحدث عن مختلف الفاعلين في السياسة العمومية بمن فيهم المجتمع المدني وأدواره الكثيرة وخاصة نشر الوعي والتحفيز والتعريف بالإمكانيات والمؤهلات التي يتوفر عليها المغرب، والأهمية البيئية للطاقات المتجددة.

Abstract:

Energy legislation is the basis on which energy markets in general, and renewable energy in particular, are based. Despite the importance of renewable energy laws and policies, it seems realistic that they are still modest in spread in many countries, and that the application of solutions provided by renewable sources remains subject to legislation, institutional frameworks, incentive policies, financing mechanisms, implementation, follow-up and evaluation approved by the state to reconcile stakeholders. While this work focused on the effective laws and institutions that frame the field of renewable energies, attention was also drawn to the fact that rationing and institutionalization alone cannot make the energy strategy successful. There are many factors and challenges that intervene in the process, including, for example, human factors and the availability of scientific and technical competencies capable of downloading and crystallizing the energy strategy in the required manner. That Morocco has, and the environmental importance of renewable energies.
