ملامح الثورة الأمريكية التنويرية في النظام الدستوري

الملخص :

توج الدستور الأمريكي كأول دستور مكتوب، لنظام حكم جمهوري ديمقراطي، مشكلا حكومة وطنية فدرالية قوية، نظامها السياسي قائم أساسا على المبادئ التنويرية الكبرى كالحرية والمساواة وفصل السلطات وغيرها، هذا الدستور بهذه المبادئ أدى دورا هاما في توحيد الشعب الأمريكي وانصهار الاختلاف والتنوع العرقي والجغرافي والديني واللغوي في المصهر الأمريكي، بعد ثورة الاستقلال ضد المستعمر الانجليزي، هذا التنوع جعل من الولايات المتحدة الأمريكية قوة عالمية بشكل مباشر دون المرور من مرحلة انتقالية كباقي الدول، ورغم المكانة الكبيرة التي تحتلها أمريكا عالميا خاصة في مجال الحقوق والحريات، إلا أنه لا يمكن التغافل عن بعض الخروقات لا سيما المساواة بين البيض والسود كأكبر معضلة تعاني منها الولايات المتحدة الأمريكية.

Abstract:

The American Constitution crowned, as the first written constitution, for a democratic republican system of government, forming a strong national federal government, whose political system based mainly on the great enlightening principles such as freedom, equality, separation of powers and others. With these principles, this constitution played an important role in the unification of the American people and the fusion of ethnic, geographical, religious and linguistic diversity in the American smelter after the revolution independence against the English colonizer, this diversity made the United States of America a global power directly  without going through a transitional phase like other countries, and despite the position that America occupies globally in the field of rights and freedoms, some violations, especially equality between whites and blacks, cannot be overlooked. As the biggest dilemma that the United states of America suffers from.
